Terms & Conditions

By registering for and participating in the Aspen Valley Marathon, Half Marathon, or 5K (the “Event”), you acknowledge and agree to the following terms and conditions and the participant waiver below.

PARTICIPANT WAIVER

1. Authority to Register and Act as Agent
By completing registration, you affirm that you have full legal authority to register yourself and/or others (the “Registered Parties”), and to use the provided payment method. If you are registering a child under 18 or an incapacitated adult, you confirm you are their parent or legal guardian and agree that the terms of this waiver apply equally to them.

2. Assumption of Risk & Waiver of Liability
Participation in a race event involves inherent risks, including but not limited to injury, accidents, and illness. You understand and accept these risks, and confirm that you and all Registered Parties are physically able and properly trained to participate.
You agree, on behalf of yourself and any Registered Parties, to release and hold harmless the Aspen Valley Marathon, its organizers, sponsors, volunteers, the towns of Aspen and Basalt, and all associated agencies (collectively, “Releasees”) from any liability related to injury, loss, or damages incurred as a result of participation.

3. Event Conditions & Modifications
You acknowledge that the event takes place on open roads and public spaces and that weather, traffic, and environmental conditions may affect safety. The organizers reserve the right to alter, postpone, or cancel the event due to unsafe conditions or acts beyond their control (including poor air quality, wildfires, natural disasters, etc.). No refunds will be issued in these cases, but a deferment to the following year may be offered at the race director’s discretion.

4. No Refunds Policy
All registrations are final. No refunds will be issued for any reason, including injury, illness, scheduling conflicts, or event cancellation due to force majeure.

5. Photo & Media Release
By participating, you grant the Aspen Valley Marathon permission to use your image and likeness in photos, video, and promotional materials without compensation.

6. Indemnification
You agree to indemnify and hold harmless the Releasees from any claims or liabilities arising from your participation, including legal fees.

7. Governing Law
This waiver and all terms herein shall be governed by and interpreted in accordance with the laws of the State of Colorado. Any disputes shall be resolved in a court of competent jurisdiction within Colorado.

BY REGISTERING, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT, AND YOU VOLUNTARILY ACCEPT ITS TERMS. YOU UNDERSTAND THAT YOU ARE WAIVING SIGNIFICANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
